SHIPPING AND HANDLING
Delivery to the job site or any other location indicated by the Buyer constitutes delivery to the Buyer or Buyer’s agent regardless of whether they are at the location at the time of delivery and sign a receipt. Metalworks will, in good faith, try to complete the delivery of all goods to the Buyer as provided by Metalworks in writing. Metalworks assumes no responsibility or liability for any loss or damage due to delay or inability to deliver, whether or not the loss or damage was made known to Metalworks.
The Buyer shall examine all goods upon receipt and prior to installation. All claims for damage, shortage, errors in shipment or improper delivery must be made to Metalworks in writing within 24 hours of delivery.

INSPECTION AND ACCEPTANCE
Buyer shall examine all goods upon receipt and prior to installation. All claims for damage, shortage, errors in shipment or improper delivery must be made to Metalworks in writing within 24 hours of delivery. After this period, the Buyer is deemed to have irrevocably received and accepted the goods and will have no right to reject the goods or revoke acceptance. Any claims for billing errors or adjustment must be made within 30 days from the invoice data to Metalworks in writing. Any claims not received in that period of time will be waived by the Buyer.
FORCE MAJEURE
Failure of Metalworks to deliver hereunder, or delay in making shipments, if occasioned by fire, explosion, flood, earthquake, insurrection, civil disturbance, accident, storm, interruption or delay of transportation, shortages, strike or other labor dispute, inability to obtain materials and supplies, acts of government, any act of God or any other causes of like or different character beyond Seller’s control shall not subject Seller to any liability to the Buyer.
